Gull Lake Realty Management LLC
Thanks for your business and we hope you enjoy your stay in our property!

DOWN PAYMENT/ PAYMENT
25% deposit is due at time of booking; 50% (75% cumulative) due 120 days prior to arrival; Final payment will be required 60 days prior to checking-in to your vacation rental. If your booking is less than 120 days the deposit will be 75% due at time of booking and final payment will be required 60 days prior to checking-in. If booking within 60 days of your stay, payment in full is due at time of reservation. 

DAMAGE POLICY
This Damage Protection program covers up to $3000.00 in accidental damage to your rented rental that occurs during your covered occupancy. Gull Lake Realty Management LLC is responsible for filing all program claims on behalf of tenants and the tenant may be notified in writing of any such claim. Tenant verification may be required in certain cases.
Tenant will be responsible for the cost of repair of all damages that exceeds the coverage limit of the Accidental Rental Damage Program. The amount you pay for the Accidental Rental Damage Protection program includes any related insurance, technology-support, service, and claims adjudication costs, along with administrative fees charged by the Gull Lake Realty Management LLC for making this coverage available.
This program does not cover intentional damage, those damages resulting from the negligence of tenant, or damages from non-compliance with the terms of this agreement. Determination of actual damages will be at the sole discretion of Gull Lake Realty Management LLC or program underwriter. 

YOUR RESPONSIBILITIES AS PROTECTED GUEST
  •     Report any accidental damage to the Property Manager when they occur;
  •     Verify damages when requested to do so by our staff;
  •     Notify the police in case of loss by theft;
  •    Take reasonable actions to protect damaged property from sustaining further damage.
TERMS OF COVERAGE
  1. The Property Protection Program takes effect upon check-in or registration on the booked arrival date to a Covered Rental, together with receipt of payment of the Program Fee at or before check-in.
  2. The Property Protection Program shall terminate upon normal check out time of the Covered Rental or the departure of the Rental-Guest, whichever occurs first.
IMPORTANT NOTICES: PROGRAM FEES ARE NON-REFUNDABLE. Payments for this program will not be accepted after the Rental-Guest has entered the Rented Rental for the beginning of their Stay. This is a general outline of the terms and conditions of The Property Protection Program. It does not include all of the terms, coverages, exclusions, limitations, and conditions of the program. TRAVEL INSURANCE

Gull Lake Realty Management LLC has partnered with RentalGuardian.com and InsureStays to help safeguard your entire booking deposit and other pre-paid non-refundable payments related to planned travel. We strongly encourage you to purchase optional travel insurance.
✓ Travel Insurance covers risks incidental to planned travel such as sickness, accidental injury, or death of you or a family member (or of a traveling companion), weather delays, natural disasters, unexpected changes in your employment, and many more specified reasons.
✓ In addition, for an additional charge, you can choose the optional CFAR benefit which pays up to 60% of pre-paid non-refundable charges should cancel for any reason not covered by standard travel insurance.
✓ The standard travel insurance coverage costs 7% of your total reservation invoice amount; if you include the optional CFAR benefits, the coverage cost is 9.8% of your total reservation invoice amount. The premium charged for travel insurance is generally non-refundable after 15 days of coverage purchase.
As a covered traveler, should you have a medical issue or experience trip delay or interruption due to unforeseen developments, you may initiate your claim by calling (833) 610-0736. EMERGENCIES/ MAINTENANCE
In the event of a problem getting into the vacation rental, or if there are problems with the condition or functionality of the vacation rental, please immediately contact our Gull Lake Realty Management LLC team member at 218-366-9501 (leave a voice message if there is no answer!) 

ARRIVAL TIME
Check in is at {reservations.property_check_in_time}. An early arrival may be arranged, pending other reservations and the housekeeping schedule. Early check-ins are not allowed during the peak Summer period. Please contact us 24-48 hours of your arrival to make these arrangements. Unless you have specifically arranged for an early arrival time, please do not arrive at the property before your scheduled check in time.

DEPARTURE TIME
Check out is at {reservations.property_check_out_time}. Your prompt departure is appreciated so we can prepare the rental for incoming guests. A 1-hour late departure may be arranged pending other reservations and the housekeeping schedule. If you have not arranged for a late check out, you may be charged $35 for each hour beyond 10 a.m. you are still on property, at a minimum of one hour. If the rental has not been vacated by 2 p.m. on your check-out day, a fee equal to the daily rental rate may be assessed.

CANCELLATIONS/POLICY

All cancellation requests must be submitted in writing via email to info@gulllakebeachresorts.com  

a.    Cancellations made within 48 hours of booking AND at least 14 days before check-in are fully refundable.  
b.   Cancellations made at least 180 days before check-in are fully refundable.  
c.   Cancellations made between 60 and 179 days before check-in are 50% refundable.   
d.   Cancellations made less than 60 days before check-in are non-refundable.   
e.    If the balance is not received at least 60 days before the check-in date, we will treat the reservation as a cancellation.  

f.    No refunds will be provided for unused time or no-shows.  

g.  We are not responsible for the weather or other acts of God, and there will be no refunds for these occurrences.  

h.  Guest is renting an individually owned property.  If Guest is not satisfied with the Property upon arrival, Guest cannot be moved to another property.  If Guest is disappointed or unsatisfied with the Property due to differences in taste according to decor, accommodations, location, construction, mountain road conditions, etc., and declines to stay at the Property, this will be considered a cancellation and no rent reduction nor refund will be issued.     
i.     We may terminate the Guest license set forth in this agreement at any time upon 7 days prior written notice (email permissible) to guest.


WEATHER CONDITIONS
Gull Lake Realty Management LLC does not issue refunds due to acts of nature such as: weather, road conditions, snow conditions, power outages or forest fires. If the property is uninhabitable due to such circumstances and you did not purchase travel insurance, reservations can be rescheduled for available future dates within one year of the reservation date.

NUMBER OF GUESTS
The guest agrees that more than the number of people stated on the reservation shall not occupy the premises. Unauthorized people at the vacation rental at any time could result in extra charges for each additional guest, in addition to any and all damage, disturbance, and cleaning charges. Group gatherings are not allowed. If there is excessive noise or music, any illegal activity, or evidence of violation of these policies, you may be asked to vacate the premise without any refund and additional charges may be assessed. Please inform us of any change in the number of guests before your arrival to avoid these charges and so the cabin can be prepared appropriately for your group. No exceptions or refunds are given for changes in the number of guests after your arrival.

AGE/GROUP POLICY
Gull Lake Realty Management LLC does not rent to students or groups of students under any circumstances. The renting guest- (must be at least 25 years of age, no exceptions), even if a parent or legally responsible adult makes the reservation. Absolutely NO house parties allowed. If such a group occupies or attempts to occupy the property, it will be required to immediately vacate and there will be no refunds.  

LINENS & TOWELS
Bath towels, bed sheets, pillows and blankets are provided. You may not remove any linens or towels. If you do, you will be charged. Towels, sheets, pillows and blankets are not meant for outside use. 

PERSONAL ITEMS
Gull Lake Realty Management LLC is not responsible for any personal property that is lost, stolen, damages or left behind. A $25.00 retrieval fee will be charged to search for personal property left behind, and if found, the items will be returned at the Guest's expense.

RIGHT OF ENTRY
Guest(s) agree that Gull Lake Realty Management LLC reserves the right to enter the rental property any time to investigate disturbances, check occupancy, check for damage, to make repairs, alterations or improvements as we may deem appropriate.

SECURITY & SAFETY RISKS
Always lock doors and windows when you leave the vacation rental! When you rent the vacation rental, you assume responsibility for it and its contents, as well as your personal property. Gull Lake Realty Management LLC does not assume any responsibility for injuries resulting from your failure to use due caution. Children must be supervised at all times. Candles are not allowed due to potential fire hazard, except citronella candles in buckets outside, or supplied emergency candles in case of power outage.

ACCOMMODATION RULES AND DUTIES OF THE GUEST
  • No pets shall be allowed in/on the premises. Detection of a pet will result in removal from the rental and a $150 cleaning fee. 
  • Smoking is not permitted in any Gull Lake Realty Management LLC property.  If there is any tobacco smell in the cabin after your departure, you will be charged a cleaning fee. Oil lamps and incense are not permitted due to the long-lasting odor. If these policies are violated, there will be a minimum $250 charge for excessive cleaning and potentially an additional cleaning fee.
  • Do not put any feminine products in the toilet. Plungers are provided if a clog occurs. Please do not pour grease down the drain.
  • No house parties, excessive alcohol use or loud noise. Quiet hours are between 11 pm and 9am. Any complaints filed with the police will result in expedited eviction.
  • Tenant is to maintain the property in a safe, clean, sanitary condition.
  • Dispose of all rubbish and garbage as directed in the check-in instruction.
  • Do not render inoperable any smoke detectors; they are for your safety.
  • Guest must use the appropriate parking spaces provided for Gull Lake Realty Management LLC properties. 

INDEMNIFICATION & HOLD HARMLESS
No guarantees are expressed nor implied regarding suitability generally or for any particular purpose with respect to the rental. All guest(s) and their invitees use the vacation property structures and premises at their own risk. Gull Lake Realty Management LLC and its property owners shall not be held liable or otherwise responsible in any way for injury to any guest and/or their invitees in any way, including harm that is caused or permitted to be caused by the intentional or unintentional acts of said guest(s) and/or invitees, or by the failure of structures, appliances, (including hot tubs and grills) furnishings, and/or other equipment, whether by malfunction, misuse, acts of god/nature, and/or are otherwise naturally occurring. Gull Lake Realty Management LLC and its property owners shall not be held liable nor otherwise responsible in any way for allergic reactions to guest(s) or invitees, caused or permitted to be caused by materials utilized in the manufacture of the vacation property and/or its contents, nor from mold and/or airborne spores, nor from pet/animal allergens, nor from chemical agents including, but not limited to appliances, linens, carpeting, utensils, fixtures, hot tubs, and/or other equipment. By written or electronic endorsement of this agreement, guest(s) and invitees hereby agree to forever hold-harmless and indemnify Gull Lake Realty Management LLC and its property owners from and against all claims, demands, loss, liability/responsibility of any kind and character, including cost of defense, arising out of or in any way connected with the guest(s) use of the property.

MEDIATION: Guest agrees to mediate any dispute or claim arising out of this Agreement, or any resulting transaction, before resorting to arbitration or court action. Mediation fees, if any, shall be divided equally among the parties involved.

JOINT AND INDIVIDUAL OBLIGATIONS: If there is more than one Guest, each one shall be individually and completely responsible for the performance of all obligations under this Agreement, jointly and individually with every other Guest.

ENTIRE CONTRACT: Time is of the essence. All prior agreements between Owner and Guest are incorporated in this Agreement, which constitutes the entire contract. It is intended as a final expression of the parties` agreement, and may not be contradicted by evidence of any prior agreement or contemporaneous oral agreement. The parties further intend that this Agreement constitutes the complete and exclusive statement of its terms, and that no extrinsic evidence whatsoever may be introduced in any judicial or other proceeding, if any, involving this Agreement. Any provision of this Agreement that is held to be invalid shall not affect the validity or enforceability of any other provision in this Agreement. The waiver of any breach shall not be construed as a continuing waiver of the same or any subsequent breach. 

RELEASE: In consideration of the right to visit the home, Guest agrees to release to the fullest extent allowed by law, Owner and its Management, members, officers, associates, employees, agents, representatives, attorneys, assigns, and affiliates (collectively, the Affiliates) from all liability or responsibility of any kind whatsoever for any personal injury, death, property damage or other loss sustained by me, my minor children, any guest identified on this form, or any guest or person allowed onto the property during my rental dates as a result of my, my childrens or the guests participation in a visit to the home, due to any cause whatsoever, including without limitation negligence on the part of Owner or Management. I understand that this release will bind my heirs, administrators, executors, and any other person or entity seeking to claim under or through me.
